2014会計年度分のH1B割り当てなくなる

2013年4月5日、移民局は、2013年10月1日からの2014会計年度分のH1B割り当て6万5000件を使い切るのに十分な数のH1B申請を受領したことを発表しました。米国の大学院以上の学位を有する者に与えられる別枠2万件についてもこれを上回る数の申請を受領したとしています。 これによって年間割り当てを必要とするH1B申請の受け付けは終了しました。 2013年4月5日が申請の最終受付日となり、同日までに受理された申請は無作為抽出抽選の上、割り当てを得るかどうかが決まります。まずは大学院以上の学位を有する者についての抽選が行われ、ここで選にもれた申請は通常の6万5000件のプールに加えられたうえ、通常のケースの抽選が行われます。全体で約124,000の申請があり、4月7日、コンピュータを使用して抽選に必要な数を選んだとのことです。割り当てを得られなかった申請は申請料とともに返却されます。 以下の申請については、H1B割り当ての対象外ですので、これからも申請提出が可能です。 すでにH1Bで米国に滞在している者による延長申請 すでにH1Bで米国に滞在している者による雇用主変更申請 H1Bビザ以外にも就労を可能にするビザがあります。申請をお考えの場合はお問い合わせください。

I-94の自動化

非移民ビザで米国を訪れる者に発行されているI-94ですが、2013年4月30日からU.S. Customs and Border Protection (“CBP”)による自動化が実行され、陸路による入国地をのぞいて、これまでのようなペーパーI-94の発行がなくなります。I-94情報は移民局ウエブサイトにアクセスすることで得られるようになり、就職時のI-9作成や、運転免許証やソーシャルセキュリティー番号の申請など、I-94の提示が必要な場合は、CBPウエブサイトからプリントして使用することになります。今のところパスポート番号でアクセスできるということのようなので、これまで以上にパスポートの安全管理が重要になると思われます。 入国手続きの際、CBPはパスポートに入国地・入国日情報のスタンプを押し、滞在ビザ資格および滞在許可期間を記載します。 CBPは、このI-94自動化により大幅な経費節減が図れるほか、入国手続きが迅速化されるとしています。I-94を紛失しても簡単にプリントできるというメリットもあります。 CBPウエブサイトによれば、自動化導入の日程は以下のようです。 Week 1 4/30/13 Charlotte Douglas International Airport, Orlando International Airport, Las Vegas Airport, Chicago O’Hare and Miami International Airport Week 2 5/7/13 Major Air and Sea Ports within the following field offices: New York, Boston, Buffalo, Baltimore, Detroit, Atlanta, Tampa, Puerto Rico, Miami, Chicago, New Orleans [...]

New Application Fees
